Gallery purchase terms

1. Scope and acceptance

These Gallery Purchase Terms («Sales Terms») govern purchases of digital content (photographs and/or videos) made by end customers («Buyer») through paid galleries enabled on the Ftens platform («Platform», «we», «us»).

By starting payment in a paid gallery, the Buyer confirms they have read and accepted these Sales Terms, Ftens’ Privacy Policy, and where relevant the Platform’s general Terms and Conditions.

2. Parties and Ftens’ role

2.1 Photographer seller

The photographer or studio that publishes the gallery and sets prices («Photographer», «Seller») is responsible for the sale of digital content: quality, selection of photographs and videos, pack description, fulfilment, and Buyer support.

2.2 Ftens as technology platform

Ftens is not the seller of the digital content. We act as a technology intermediary: gallery hosting, watermarked previews, payment via Stripe Connect, and download or playback access after payment.

Payments are processed for the Photographer through their connected Stripe account. Ftens may retain a platform fee disclosed before payment, according to current settings.

2.3 Sale contract

The contract for supply of the purchased digital content is formed directly between the Buyer and the Photographer. Ftens does not guarantee artistic outcome or fitness for a particular purpose, except as stated in the Photographer error clause below.

3. Subject matter: digital content

3.1 What is purchased

The Buyer acquires a personal use licence for the digital photographs and/or videos (without watermark) included in the paid pack or selection, in the formats, resolutions, and codecs the Platform makes available at download or playback time.

Unless otherwise agreed in writing between Buyer and Photographer, the following are not granted:

  • Resale or sublicensing of files.
  • Use in stock libraries, mass merchandising, or third-party campaigns without express licence.
  • Modifications that infringe copyright or third-party personality rights.
  • Commercial use unless the Photographer has expressly authorised it in writing.

3.2 Content types and packs

The Photographer may configure photo packs, video packs, or both in the same gallery. Each payment transaction covers a single content type (photographs or videos), according to the pack chosen by the Buyer. To buy both photos and videos, separate purchases are required when the Photographer offers both types.

3.3 Immediate delivery

After successful payment, access to watermark-free downloads or playback is provided immediately or shortly thereafter via link, session cookie, and/or email. The Buyer is responsible for keeping access and downloading or viewing within a reasonable time.

3.4 Watermarked preview

Photographs and videos shown before payment may carry a watermark or other preview quality limitations. The Buyer acknowledges that the paid version corresponds to the content (photos or videos) selected and paid for under the chosen pack.

3.5 Videos: formats and compatibility

Videos are delivered in the technical formats the Platform offers at any given time (for example, downloadable video files). The Buyer is responsible for suitable devices, players, and bandwidth. Incompatibility with a particular player does not, on its own, constitute a file defect unless the file is corrupt or substantially different from what was purchased.

4. Price and payment

  • The total price is shown before redirecting to Stripe Checkout.
  • Payment is made using methods supported by Stripe.
  • Stripe processing fees may apply to the Photographer; net amounts in Stripe Express may be lower than the gross price shown to the Buyer.
  • Ftens does not store full card details.

5. Refunds and right of withdrawal

5.1 General rule: no money back

We do not offer refunds of the amount paid as a standard policy. Once payment is completed and download or playback access has been granted, the Buyer has no right to a refund, as this is digital content supplied without physical media delivered with their consent.

Ftens and the Photographer are not obliged to return money for change of mind, aesthetic preference, or any reason other than those in clause 5.2.

5.2 Sole exceptions (Photographer’s decision)

A refund of money may only be considered, exceptionally, if the Photographer, after reviewing the Buyer’s claim, in good faith considers that there was an error in the delivered content or a failure that reasonably prevented access to what was purchased. Examples include:

  1. Incorrect or defective content attributable to the Photographer: wrong files, corrupt files, substantial duplicates, clearly lower quality than promised, or photographs or videos that do not match the purchased pack.
  2. Access failure to paid content that the Photographer acknowledges after checking (including, where applicable, a persistent Platform technical issue not resolved within a reasonable time after notice to the Photographer or Ftens).

In these cases, the Photographer may choose to correct delivery (replacement files or renewed access) instead of refunding money. Any monetary refund, if granted, is at the Photographer’s sole discretion and is not an automatic Buyer right.

Duplicate charge or verified payment amount error: Ftens may correct the charge without the Photographer’s assessment.

5.3 What does not entitle to a refund

Among others, no refund is due for: change of mind, personal taste, comparison with other sessions, Buyer device issues, editing software or player incompatibility (unless the file itself is defective), Buyer network limitations, or claims made outside the time limit without justified cause.

5.4 Procedure

The Buyer must contact within 14 days of purchase, stating purchase email, gallery, and a description of the issue, primarily to the Photographer.

If there is no reasonable response or the matter concerns duplicate charging or Platform operation, they may write to Ftens: info@ftens.com (subject: «Gallery purchase claim»). Ftens may help with communication but does not replace the Photographer’s assessment of content quality or suitability.

If the Photographer approves a refund, it will be made via the original payment method where possible, or under another express agreement between Buyer and Photographer.

5.5 Right of withdrawal (EU consumers)

If the Buyer is a consumer in the European Union, they may have a 14-day withdrawal right for distance contracts, unless they have expressly requested immediate supply of digital content and acknowledge loss of the withdrawal right once download starts or access is delivered, as applicable law requires.

By checking the acceptance box before payment, the Buyer confirms this request for immediate supply where required by law.

6. Photographer obligations

The Photographer warrants, to the extent of their responsibility:

  • Necessary rights to commercialise photographs and videos (author, assignment, or licence).
  • Personality / likeness consents and, where applicable, music or third-party rights embedded in videos, where required by law.
  • Clear pricing and packs, indicating the content type (photos or videos) for each option.
  • No illegal, defamatory, or third-party infringing content.

The Photographer shall indemnify Ftens against third-party claims arising from their content or breach, to the extent permitted by law.

7. Buyer obligations

The Buyer agrees to:

  • Provide a valid email for access and communications.
  • Not publicly share download links enabling mass unauthorised use.
  • Not initiate fraudulent chargebacks without following clause 5 first.

Unjustified chargebacks may result in access being revoked and cooperation with the Photographer and Stripe in dispute handling.

8. Limitation of Ftens’ liability

To the maximum extent permitted by law, Ftens shall not be liable for:

  • Indirect damages, lost profits, or lost opportunities arising from the Buyer–Photographer relationship.
  • Visual content, editing, video processing delays, or quality attributable to the Photographer.
  • Short service interruptions due to maintenance, force majeure, or third parties (including Stripe).

Ftens’ total liability to the Buyer for a given order, if ever established, shall not exceed the platform fee Ftens received for that order or, if none, EUR 50, whichever is greater within mandatory legal limits.

9. Claims, disputes, and governing law

  • Claims about photograph or video quality or content: primarily to the Photographer.
  • Claims about Platform or payment operation: info@ftens.com.

These Sales Terms are interpreted under the law of Ftens’ country of establishment, without prejudice to mandatory consumer protection rules in the Buyer’s country of residence.

10. Changes

We may update these Sales Terms. The current version will be published at this URL with an update date. Purchases are governed by the version accepted at payment time.
